Understanding the K-1 Fiancé Visa Process
With a K-1 visa, a U.S. citizen’s foreign fiancé can come to America with the intention of getting married. While immigrant visas are available to already married couples who meet certain qualifications, the K-1 visa is specifically for couples who have not yet married. Understanding what if you are stopped by immigration in North Carolina is also vital for foreign nationals awaiting adjustments.
Generally, under 8 U.S.C. § 1184(d), the couple must have met in person within the last two years before filing their petition. There are limited exceptions to this requirement. Additionally, both individuals must be legally able to marry and have the intention to marry within 90 days after the foreign fiancé enters the United States.
The fiancé visa process usually begins when the citizen of the United States files Form I-129F, Petition for Alien Fiancé, with U.S. Citizenship and Immigration Services (USCIS). Approval of the I-129F does not automatically allow the foreign fiancé to come into the United States. Instead, the case is typically transferred to the National Visa Center, then sent to the proper U.S. embassy or consulate to continue processing.
Fiancé visa couples living in University City, Ballantyne, Steele Creek, and other Charlotte neighborhoods follow the same federal guidelines as applicants in the rest of North Carolina.
Who Qualifies for a Fiancé Visa?
There are many factors that go into determining eligibility. Each couple’s circumstances are unique and must meet certain criteria established by federal immigration law. A United States citizen must file the petition and show they have a qualifying relationship with their foreign fiancé. Lawful permanent residents do not qualify to petition for a K-1 visa but may have other options after marriage. The basic eligibility requirements are:
- United States citizenship. The person filing the petition must be a citizen of the United States, not just a lawful permanent resident.
- Legal capacity to marry. Neither person can be currently married or otherwise ineligible to enter into a marriage.
- Intent to marry. The couple must plan to marry each other within 90 days of the foreign fiancé’s admission to the United States.
- In-person meeting. Except under limited circumstances, the couple must have met each other in person at least once within the two years prior to petitioning.
- Genuine relationship. The relationship must be bona fide and not for the purpose of obtaining immigration benefits.
In addition to these eligibility requirements, applicants must be admissible to receive a visa. Certain criminal convictions, prior removals, or medical conditions could complicate eligibility. A Charlotte fiancé visa attorney can go over these issues before filing the petition to determine if you need to submit additional documentation or if there is another immigration process available.
Applying for a K-1 Visa
Even though federal fiancé visa laws govern the K-1 visa process, Charlotte residents can complete much of the preparation locally. To apply for a K-1 visa, complete the following steps:
File Form I-129F With USCIS
A United States citizen who wishes to sponsor their fiancé must file Form I-129F along with proof of citizenship, their relationship, and intent to marry. Evidence can include passports, photos, divorce decrees, and proof of an in-person meeting. File Forms according to the latest USCIS instructions because addresses and fees may change over time.
Complete Consular Processing
Once USCIS approves the Form I-129F petition, the National Visa Center sends the fiancé visa case to the U.S. embassy or consulate in charge of processing the applicant’s visa. The foreign fiancé typically completes Form DS-160, schedules a medical exam with an approved doctor, and attends a visa interview. Other requirements may apply based on the applicant’s country of origin and immigration history.
Attend the Visa Interview
The consular officer conducts an interview to verify the applicant’s eligibility. The officer may ask questions about the relationship, previous marriages, and intentions after entering the United States. Make sure to answer all questions truthfully. Your responses should be consistent with the information in your application. Failure to provide requested evidence or clear up concerns can lead to further delays or denial of the visa.
Enter the United States and Get Married
If granted a K-1 visa, the foreign fiancé can travel to the United States. The couple needs to marry within 90 days of admission. Note that traveling to the United States on a K-1 visa does not grant any immigration status. K-1 status cannot be extended to give the couple more time to marry. Charlotte couples marry through the Mecklenburg County Register of Deeds, which issues marriage licenses at 720 East Fourth Street, Charlotte, NC 28202.
Evidence to Establish a Genuine Relationship
USCIS and embassy or consulate officials want to see proof that you and your fiancé know each other and plan to marry. If you live in different countries, it might be difficult to meet in person. Keep good records that show how your relationship progressed.
Acceptable evidence includes photos from visits, travel documents, passport stamps, emails, and other documentation of regular communication. Evidence of wedding plans can also show the couple’s intentions. Remember that meeting the eligibility requirements is still necessary to qualify for the visa.
Never provide false documents or information to try to prove your relationship. Doing so can have immigration consequences that affect more than the K-1 application.
The K-1 Visa Application Process
K-1 visa processing times vary depending on USCIS caseloads, availability of consular interviews, and whether further investigation is required. Statistics from previous years can show how changes in application volume can impact processing times. USCIS received 56,382 Form I-129F petitions in fiscal year 2024. It was also reported that the Form I-129F average processing time was 8.5 months during fiscal year 2024.
Keep in mind these statistics are from previous years and do not indicate how long an individual case may take to process. Form I-129F petitions and K-1 visas are approved at different stages of the process. Each number should be treated independently.
What Happens After the Wedding
Marriage by itself does not grant the foreign spouse lawful permanent residence in the United States. However, once married to the United States citizen petitioner, the foreign spouse can typically file Form I-485 with USCIS to apply for adjustment of status. The applicant may be required to submit a marriage certificate, a medical examination from an approved doctor, and proof of financial support. It is also possible that the applicant may need to attend an interview.
While their application is pending, foreign spouses should understand the limitations on employment and travel. Marriage does not automatically grant work authorization or the ability to travel outside of the United States. Information about marriage license applications and other local procedures is available through the Mecklenburg County Register of Deeds.
Hire a Fiancé Visa Lawyer for Your Immigration Case
Immigration attorneys can determine if you meet the K-1 visa eligibility requirements before filing Form I-129F. This includes reviewing past marriages, international travel, criminal history, and potential inadmissibility issues that may affect eligibility.
A Charlotte fiancé visa attorney can also help you identify weaknesses in your relationship documentation and assist with responding to any requests for information from USCIS. They can help you correct any inconsistencies that may harm your fiancé’s visa application.
If a visa gets denied or a petition is rejected, legal representation can review the reasons for denial. Then an attorney can decide if re-filing the application or another available option is a better course of action. Attorneys can also guide couples on whether a K-1 visa or a marriage-based immigrant visa is a better option. These are two different paths with specific rules and qualifications.
